By using heynuck.com and/or placing an order, you agree to the terms below and our Privacy Policy.

1) Scope & Entire Agreement

These Terms govern your access to the Site and purchases from Heynuck. Any conflicting terms (e.g., in your PO/email) are void unless we expressly agree in writing. If any provision is unenforceable, the rest remain in effect.

2) Order Acceptance

Your order is an offer. We’ll confirm receipt by email, but acceptance occurs when we ship (or when we send a final acceptance notice). We may cancel and refund orders that cannot be fulfilled (e.g., stock, pricing/system errors, fraud screening).

3) Products & Availability

We aim for accurate descriptions, sizing, and images; minor variations may occur (color/placement due to screens or production tolerances). If a material change or substitution is necessary, we’ll seek your consent; otherwise we’ll cancel and refund.

4) Pricing & Currency

Prices are listed in Canadian dollars (CAD) and exclude applicable GST/HST/PST unless stated otherwise. We may change prices without notice before you place an order. If a pricing error appears, we may cancel and refund before shipment.

5) Taxes, Duties & Licences

Taxes are calculated at checkout by ship-to province/territory. International recipients are responsible for import duties/taxes where applicable.

6) Payment Terms

We accept the payment methods shown at checkout (e.g., Visa/Mastercard/Amex, Shop Pay, Apple Pay, Google Pay, PayPal, Afterpay, Skrill, and regional options where available). We use PCI-DSS–compliant providers and do not store full card details. We may require pre-payment or verification to prevent fraud.

7) Shipping, Risk & Title

Shipping options and timelines are shown at checkout; see our Shipping Policy for current SLAs and rates. Risk of loss passes on delivery to your shipping address (or on pickup, if applicable). Title passes when we receive full payment. Please inspect parcels upon arrival and notify us promptly of damage/loss.

8) Processing & Delivery Time

Processing typically takes 3–7 business days; transit timelines depend on service level and destination. Weather, holidays, customs, or carrier issues may extend delivery.

9) Returns, Exchanges & Refunds

You may request a return within 30 days of delivery for unused, unwashed items with original tags/packaging. Certain items are final sale (e.g., personalized items, gift cards, hygiene-sensitive items) and not returnable.

  • Change of mind/size: return shipping at customer expense.
  • Defective/damaged/incorrect: we’ll cover reasonable return shipping or offer a free replacement.

10) Cancellations & Modifications

Contact us ASAP after ordering to request address/item/size changes or cancellation. We can assist before dispatch; once shipped, please follow the return process.

11) Use of Site

You agree not to misuse the Site (e.g., interfere with security, scrape, or exploit content). Content (texts, graphics, trademarks) is owned by Heynuck or its licensors and protected by IP laws.

12) Warranties & Disclaimers

To the extent permitted by law, products are provided with the warranties required by applicable consumer protection laws. We disclaim any additional express or implied warranties (including merchantability/fitness for a particular purpose) where lawful. Nothing here limits your statutory rights (including in Québec).

13) Limitation of Liability

To the maximum extent permitted by law, Heynuck’s aggregate liability for any claim related to your purchase or use of the Site is limited to the amount you paid for the product(s) at issue. We are not liable for indirect, incidental, special or consequential losses (e.g., loss of profits, data), except where prohibited by law.

14) Indemnity for Improper Use

You are responsible for the proper selection and use of products. You agree to indemnify Heynuck for claims arising from misuse, modification, or installation contrary to our instructions to the extent permitted by law.

15) Force Majeure

We are not responsible for delays or failures caused by events beyond our reasonable control (e.g., natural disasters, acts of government, strikes, carrier disruptions).

16) Changes to Terms

We may update these Terms from time to time. The version posted at the time of your order applies to that purchase.

17) Governing Law & Disputes

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada, without regard to conflict-of-laws rules. You consent to the jurisdiction of the courts in Ontario for any dispute.
Consumer rights notice: Nothing in these Terms limits rights you may have under applicable consumer protection legislation (including in Québec).
